Garnet Health Can Be Held Liable For Wrongful Death Even Though ER Doc Was Not Employee

Order By Schick Reversed By Third Department


HARRIS - The Appellate Division/Third Department on Thursday reversed an order by State Supreme Court Justice Stephan Schick that dismissed a wrongful death complaint against Garnet Health/Catskills.


The case was filed by John Fasce, the administrator for the estate of Ann Fasce, who died at the hospital in 2016.


At issue was whether Garnet Health (then Catskill Regional Medical Center) could be held liable for the actions and decisions by an emergency room physician -- Kim Tam Vaugeois - who was not a Catskill Regional employee but a contractor from Crystal Run Healthcare.


"We said the hospital was responsible for all the doctors who cared for her," said personal injury attorney Stanley Landers, who represented Fasce, in a brief interview with The SullivanTimes on Friday.


A spokesperson for Garnet Health could not immediately be reached for comment.
