Judge Throws Out Vegliante's Ballot Challenge in Fallsburg Supervisor Race; BOE Can Continue Canvass

Rich Klein

Updated: Jan 7, 2022

The contested race for Town Supervisor in Fallsburg, along with two council seats, will be decided early next week after the Board of Elections completes its canvass of ballots that were previously set aside after challenges by incumbent Steve Vegliante.

But Vegliante's ballot challenge was thrown out today in a decision made public by Acting State Supreme Court Justice Mark Meddaugh.

With that, there's now a strong possibility that Katherine Rappaport (Preserve Sullivan) will prevail in the race.

If she does, it would also likely result in the the defeat of incumbents Nathan Steingart and Michael Bensimon for the town council. They would be replaced by Sean Wall-Carty and Miranda Behan.

It's unclear at press time if Vegliante would have any remaining legal options available should the Board of Elections declare Rappaport the winner.
