Stipulation To Be Filed Today With Judge in Martucci vs Metzger Case - Needs Approval From Parties

On Friday, November 6, a hearing was held before Acting State Supreme Court Justice Richard Northrup Jr. (Delaware County) in connection with the Election Law petition filed by Mike Martucci, the 42nd District candidate, who leads incumbent Jen Metzger before absentee ballots have been counted.


The discussion among attorneys for both candidates and all the Boards of Elections in the District - plus the New York State Boards of Elections - centered around coming to agreement on language for canvassing the ballots.


Below is the stipulation that was expected to be filed with the court this morning on that issue by John Ciampoli, the attorney for Martucci. The stipulation requires formal approval from all parties before it becomes binding.


Thomas Cawley, deputy county attorney, is representing the Sullivan County Board of Elections.


Although Martucci claimed victory after Election Day last week, Metzger issued a statement pointing out that the 25,000 absentee ballots that have to be counted are overwhelmingly from Democratic voters.
